JA PROGRAM RELEASE POLICIES
In consideration for being accepted by the JA Parties for participation in Camp to be provided by the JA Parties, the undersigned Child and Parent(s): ASSUME ANY AND ALL RISKS, LIABILITY AND RESPONSIBILITY involved in or arising from child’s travel to and from the Camp and child’s participation in Camp and all activities at Camp including without limitation the risks of property damage, sickness, bodily injury or death resulting from the foregoing, whether or not caused by the negligence or other fault of the JA Parties.
Release, agree to indemnify and hold harmless from and agree not to sue the JA Parties on account of or in connection with any and all claims, liabilities, demands, obligations, causes of action, damages, losses, costs and expenses, including without limitation attorney’s fees, of any nature whatsoever, known or unknown, fixed or contingent, whether or not caused by the negligence or other fault of the JA Parties; including, without limitation, any and all claims arising out of or connected with any property damage, sickness, bodily injury or death, as well any and all expenses of any nature whatsoever which may be incurred or sustained by child while traveling to and from the site for Camp, during or in connection with Camp in any way, and during the child’s participation in any and all activities associated with Camp, and any claim arising out of strict product liability or any other liability without fault and further release, agree to indemnify and hold harmless the JA Parties against loss from any future claims, demands, damages and rights or actions not known to either party hereto, or which may later develop or be discovered and that may subsequently be brought by child or by any other person or persons on account of any property damage, sickness, bodily injury or death which may be incurred or sustained by child during or in connection with the foregoing and further agree to reimburse and make good to the JA Parties any loss, damages or costs the JA Parties may have to pay as a result of any such action, claim or demand.
Waive the protection afforded by any statute or law in any jurisdiction (e.g., California Civil Code § 1542) whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing the release. Agree to pay for any and all injuries and damages caused by child, negligently, willfully, or otherwise to child, to any other person, to the JA Parties and to any property.
I hereby authorize officials of Junior Achievement to contact directly the persons named on this form and authorizes the named physicians to render such treatment as may be deemed necessary in their judgment, for the health of the child named above. I hereby release and discharge Junior Achievement of San Diego from any and all financial responsibility for the medical care and/or transportation of such child to receive medical care. I agree to indemnify and hold harmless Junior Achievement of San Diego from any and all claims, damages, costs, attorney’s fees or damages of any kind arising out of participation in JA Camp by the child attached to the registration.
I give permission for my child to receive medication from the Junior Achievement Staff. I will assume responsibility for safe delivery of the medication to and from the facility by my child. I will notify the Junior Achievement Staff if there are any changes in the use of the medication or the prescribed treatment.
I release and agree to hold all personnel of Junior Achievement harmless from any and all liability for damages or injury resulting directly or indirectly from this authorization.
In consideration of the opportunity to appear in the Junior Achievement USA and Junior Achievement of San Diego County, photography or video materials or any and all additional materials created now or in the future by or for Junior Achievement USA (the “Materials”) and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, I, hereby grant the right to photograph, record, video tape and/or utilize my image, voice, picture, name, silhouette, or other reproduction of my physical likeness (hereafter called “Media”) for and on behalf of Junior Achievement USA, specifically for use in the Materials and marketing thereof.
I grant Junior Achievement USA and its employees, agents, successors, assigns, and affiliates (collectively referred to herein as “Junior Achievement USA”) the exclusive, royalty-free and irrevocable right and license to:
1) Reproduce, use, re-use, publish, display, copyright, and distribute all Media contained in the Materials, or any portions thereof, in connection with any and all mediums now known or hereinafter developed, for any purpose and on a worldwide basis.
2) Reproduce, use, re-use, publish, display, copyright, and distribute the Media contained in the Materials, or any portions thereof, in connection with any promotion, advertising, and publicity of the Materials, on a worldwide basis.
I release and discharge Junior Achievement USA and the above named photographer(s), knowing that Junior Achievement USA and the photographers are relying on this release at substantial cost, from any claims or demands made by me in connection with the authorized use of the Media in the Materials including but not limited to claims for libel, slander, invasion of privacy, rights of publicity, and/or copyright infringement.
I understand that the copyright to the Media and the Materials will and does reside with Junior Achievement USA, and to the extent it is not deemed a work-made-for-hire or not otherwise deemed owned or held by Junior Achievement USA for any reason, then I hereby assign any such copyrights and related rights I may have in the Media and Materials to Junior Achievement USA.
For any content that I have created or used which is displayed by me in the Materials (and that was not provided to me by Junior Achievement USA), I represent that I have created such content on my own, and that such content is not owned by, nor does it infringe on the intellectual property rights of any third party. I hereby agree to indemnify, defend, and hold Junior Achievement USA and the above-named photographer(s) harmless from any and all actions, damages, and liabilities that may arise by a breach of my representations in this paragraph.
I have read and understood this Agreement and the terms hereof. This agreement shall be governed by the laws of the State of California.
